Trade Secrets

Generally, trade secret law protects ideas, facts, and know-how, whether in tangible form or not. A trade secret can be defined as any method or apparatus that is used in one’s business and provides a competitive advantage or a potential competitive advantage. The proprietary information must be kept secret so that, except by improper means, it is difficult to acquire. A famous example of a trade secret is the Coca Cola formula. Trade secrets require no filing with a state or federal government agency. Because no filing is required, it does not expire. Thus, a trade secret may last forever.

I have extensive experience identifying and maintaining trade secrets for a variety of clients. I can assist you in setting up a system for creating a trade secret and maintaining it appropriately. I can also help you establish systems for policing and enforcing your trade secrets. I can further advise you regarding the protection of your inventions using a combination of patents, trademarks, copyrights and trade secrets.

As a Board Certified Specialist in the area of Intellectual Property Law, I can assist you with your trade secret needs.
